1. Agreement
These terms are an agreement between you and Oğuzhan Aktay, an individual developer based in Türkiye who publishes apps under the brand Inovy (“we”, “us”). Postal address: Cumhuriyet Mah., Diyar Sk. No: 5, 16400 İnegöl, Bursa, Türkiye. By downloading or using Fern: Focus & Grow (“Fern”) you agree to these terms. If you do not agree, please do not use the app.
2. What Fern does
Fern is a focus timer: a plant grows while you focus, blooms onto your Garden shelf and drops seed packets that hold new seeds or pots. We grant you a personal, non-exclusive, non-transferable, revocable licence to use Fern on Apple devices you own or control, in line with Apple’s Standard EULA.
Fern is a tool for focus, not a medical or wellbeing service. Plants, seeds, pots and secrets are in-app items for fun: they have no cash value and cannot be sold, transferred or exchanged.
3. No account
Fern has no accounts and no sign-in. Your garden is stored only on your iPhone, so it cannot be moved to a new device or recovered after you delete the app. Fern Pro is linked to your Apple ID and can always be restored (section 6).
4. Free and Fern Pro
Every plant, pot, secret and the whole Garden are free. The free version gets one seed packet from every bloom (three from your first bloom). Fern Pro gets three seed packets from every bloom and lets you redraw each seed once. We may change what Free and Pro include in future versions.
5. Subscriptions, free trial and auto-renewal
- Fern Pro is an auto-renewing subscription, offered yearly (with a 7-day free trial for eligible users) or monthly. The price for your country is shown in the App Store and on Fern’s Pro screen before you buy.
- Payment is charged to your Apple ID when you confirm the purchase or, for the trial, when the trial ends.
- The free trial turns into a paid yearly subscription when it ends, unless you cancel at least 24 hours before it ends. Each Apple ID can use the trial once.
- Subscriptions renew automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the period ends.
- To cancel, open iOS Settings → your name → Subscriptions → Fern, or Manage subscription in Fern’s Settings. Cancelling stops the next renewal; you keep Pro until the end of the period you paid for. Deleting Fern does not cancel a subscription.
- If a price changes, Apple tells you before it applies, and asks for your agreement where required.
6. Restoring Fern Pro
On a new iPhone, or after reinstalling Fern, tap Restore on the Pro screen or Restore purchases in Settings while signed in with the Apple ID that bought Fern Pro. Adapty helps us confirm your subscription.
7. Refunds
Fern Pro is sold and billed by Apple, so we cannot issue refunds ourselves. Ask Apple at reportaproblem.apple.com; requests are handled under Apple’s policies, except where the law gives you other rights.
8. Acceptable use
Do not copy, modify, reverse engineer or resell the app, interfere with our servers, or use Fern to break the law, except where the law allows it.
9. Disclaimers and liability
Fern is provided “as is” and “as available”, without warranties of any kind, and we do not promise that it will be uninterrupted or error-free. Timers, notifications and Live Activities depend on iOS and your device settings. To the extent permitted by law, we are not liable for indirect or consequential losses, including the loss of in-app items when the app is deleted, and our total liability is limited to the amount you paid for Fern in the 12 months before the claim. Nothing here limits rights you have under mandatory consumer law.
10. Ending use
You can stop using Fern at any time by deleting the app; see the Privacy Policy for what that removes and how to have feedback deleted. Deleting the app does not cancel a subscription.
11. Governing law
These terms are governed by the laws of the Republic of Türkiye, without limiting the mandatory consumer protections of the country where you live. Users in the EU keep the mandatory protections of their local law.
12. Changes
We may update these terms and will change the effective date above when we do. For important changes we will also tell you in the app. Continued use after an update means you accept the new terms.
